2.2 You represent and warrant that you are at least 18 years old, that you have the legal authority to enter into these Terms, and that if you are acting on behalf of a legal entity, you have the authority to bind that entity to these Terms.
2.3 These Terms constitute a legally binding agreement between you and Trust Agency. Together with the Privacy Policy and Cookie Policy (available on the Platform), they form the entire agreement between you and Trust Agency with respect to the use of the Platform.
2.4 The Platform is designed for business and professional use. By accepting these Terms, you confirm that you are acting in a professional or business capacity and not as a consumer.
3.1 Trust Intelligence is a B2B intelligence portal that tracks ETSI standards and eIDAS regulations within the European digital identity ecosystem. The Platform provides curated intelligence to help professionals and organisations navigate developments in this field.
3.2 The Services include:
3.3 Trust Agency may modify, expand, or discontinue any aspect of the Services at any time, subject to the notice provisions in Section 16 of these Terms.
3.4 The Platform does not provide legal, regulatory, or compliance advice. Content is provided for informational and intelligence purposes only. Users are responsible for seeking independent professional advice before making decisions based on information obtained through the Platform.
4.1 To access the Platform, you must create an Account by providing accurate, complete, and current registration information, including a valid email address, and creating a secure password.
4.2 You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to:
4.3 Each Account is personal and non-transferable. You may not create multiple Accounts or create an Account on behalf of another person without their authorisation.
4.4 Trust Agency reserves the right to refuse registration, or to require additional verification of identity or professional affiliation, at its discretion.
4.5 You are responsible for ensuring that the information in your Account remains accurate and up to date. Trust Agency is not liable for any consequences arising from inaccurate or outdated Account information.
5.1 Current offering. The Platform currently operates under a Free Tier model. Registered Users receive access to the Services, including the weekly Newsletter, at no charge. The Free Tier includes access to topic pages, the eIDAS relationship map, the Newsletter, and published Content.
5.2 Future Paid Services. Trust Agency may introduce Paid Services in the future, including but not limited to premium subscription tiers, advanced intelligence features, training programmes, workshops, certification courses, and consulting services. Any Paid Services will be governed by supplementary terms (“Subscription Terms“) that will be presented to you prior to purchase and will apply in addition to these Terms.
5.3 Introduction of Paid Services. If Trust Agency introduces Paid Services that affect your access to features currently included in the Free Tier, we will notify you at least sixty (60) days before such changes take effect. In such event:
5.4 Pricing and payment. When Paid Services are introduced, applicable fees, billing cycles, accepted payment methods, and refund policies will be set out in the Subscription Terms. Trust Agency reserves the right to modify pricing for Paid Services with at least thirty (30) days’ prior notice and for objectively justified reasons, such as changes in operating costs, market conditions, or scope of services. Users who do not accept a price change may terminate their subscription before the new pricing takes effect.
5.5 Training offerings. Trust Agency may offer paid training programmes, workshops, or educational sessions related to the subject matter covered by the Platform. These will be subject to separate terms and conditions specific to each training offering.
6.1 As part of the Services, Trust Agency delivers a weekly Newsletter containing curated intelligence on changes in ETSI standards, eIDAS regulations, and related developments in the European digital identity ecosystem.
6.2 Consent and legal basis. By creating an Account, you consent to receiving the Newsletter as an integral part of the Services. The Newsletter relates directly to the Services for which you registered and constitutes a communication about similar services within the meaning of Article 13(2) of the ePrivacy Directive as transposed into Belgian law. You will be given a clear opportunity to opt out of the Newsletter both at the time of registration and in every subsequent communication.
6.3 Managing your preferences. You may adjust your Newsletter and communication preferences at any time through your Account settings or by using the unsubscribe link included in every Newsletter. Opting out of the Newsletter does not terminate your Account or your access to the Platform.
6.4 Service communications. Regardless of your Newsletter preferences, Trust Agency may send you essential service-related communications, including Account verification emails, security alerts, notifications of material changes to these Terms or the Services, and other transactional messages necessary for the operation of your Account. These are not marketing communications and cannot be opted out of while your Account remains active.
6.5 Trust Agency will not send marketing communications unrelated to the Services without your prior explicit consent.
7.1 General obligations. You agree to use the Platform in a lawful, ethical, and responsible manner, in accordance with these Terms and all applicable laws and regulations.
7.2 Prohibited conduct. You shall not, and shall not attempt to:
7.3 User Content responsibility. You are solely responsible for any User Content you submit through the Platform. By submitting User Content, you represent and warrant that you have all necessary rights to do so and that such content complies with these Terms and applicable law. Trust Agency reserves the right, but has no obligation, to monitor, review, or remove User Content at its sole discretion.
7.4 Reporting violations. If you become aware of any content or conduct on the Platform that violates these Terms or applicable law, you may report it by contacting us at the details provided in Section 20.
7.5 Consequences. Violation of this Section may result in a warning, temporary suspension, or permanent termination of your Account, as set out in Section 15, and may expose you to civil or criminal liability.
8.1 Ownership. All Content on the Platform — including but not limited to the database structures, categorisation schemes, relationship maps, analyses, compilations, curated summaries, topic page layouts, newsletter content, graphics, software, and the Platform’s overall design and “look and feel” — is the exclusive property of Trust Agency or its licensors and is protected by copyright, the EU sui generis database right (Directive 96/9/EC), trademark law, and other applicable intellectual property laws.
8.2 Limited licence. Subject to your compliance with these Terms, Trust Agency grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform and Content solely for your internal business and professional information purposes during the term of your Account. No right, title, or interest in any Content is transferred to you.
8.3 Value-added content distinguished from source material. While the underlying ETSI standards and eIDAS regulations referenced on the Platform may be publicly available and subject to their own licensing terms, Trust Agency’s value-added content — the selection, arrangement, analysis, categorisation, relationship mapping, and curated presentation of such information — constitutes proprietary intellectual property of Trust Agency. This protection extends to the compilation as a whole and to any substantial part thereof.
8.4 Restrictions. Without Trust Agency’s prior written consent, you may not:
8.5 Trademarks. “Trust Intelligence,” “Trust Agency,” and associated logos and branding are trademarks or trade names of Trust Agency. Nothing in these Terms grants you any right to use these marks without prior written consent.
8.6 Feedback. If you provide Trust Agency with suggestions, ideas, or feedback regarding the Platform or Services (“Feedback“), you grant Trust Agency a perpetual, irrevocable, worldwide, royalty-free licence to use, modify, and incorporate such Feedback without any obligation to you.
8.7 Survival. The intellectual property provisions in this Section survive the termination or expiration of your Account. Upon termination, you must cease all use of Content and delete any downloaded copies.
9.1 The Platform may contain references, links, or citations to standards, regulations, publications, and resources published by third parties, including ETSI, the European Commission, EU Member State authorities, and other standards bodies. Trust Agency does not control, endorse, or assume responsibility for third-party content.
9.2 References to ETSI standards, eIDAS regulations, and other official documents are provided for informational and intelligence purposes. Users should always consult the original official publications for authoritative versions.
9.3 Any third-party content accessible through the Platform is subject to the terms and conditions of its respective publisher. Trust Agency is not liable for the accuracy, completeness, or availability of third-party content.
10.1 Data controller. Trust Agency acts as the data controller for personal data processed through the Platform. Our processing of your personal data is governed by our Privacy Policy, which is available on the Platform and forms an integral part of these Terms.
10.2 Categories of personal data. In the course of providing the Services, we process the personal data you provide during registration (such as name, email address, organisation, professional role), your login credentials (password stored in encrypted form), and technical data generated through your use of the Platform (such as IP address, browser type, and usage analytics).
10.3 Purposes and legal bases. We process your personal data for the following purposes:
10.4 Your rights. Under the GDPR, you have the right to access, rectify, erase, restrict processing of, and receive a portable copy of your personal data, and the right to object to processing. You have an absolute right to object to processing for direct marketing purposes at any time (Article 21(2) GDPR). To exercise any of these rights, contact us at the details in Section 20.
10.5 Supervisory authority. You have the right to lodge a complaint with the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit / Autorité de protection des données), Drukpersstraat / Rue de la Presse 35, 1000 Brussels, Belgium (www.dataprotectionauthority.be), or with the supervisory authority of your habitual residence.
10.6 International transfers. If personal data is transferred outside the European Economic Area, such transfers will be subject to appropriate safeguards in accordance with Chapter V of the GDPR, including European Commission Standard Contractual Clauses or adequacy decisions. Details are set out in the Privacy Policy.
10.7 Data retention. We retain your personal data for as long as your Account is active and for a reasonable period thereafter as necessary to comply with legal obligations, resolve disputes, and enforce these Terms. Specific retention periods are set out in the Privacy Policy.
10.8 Security. Trust Agency implements appropriate technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, or destruction, in accordance with Article 32 GDPR.
10.9 Cookies. The Platform uses cookies and similar tracking technologies. Our use of cookies is governed by our Cookie Policy, available on the Platform, which provides information on the types of cookies used, their purposes, and how you can manage your cookie preferences. Non-essential cookies require your prior consent.
11.1 Trust Intelligence is supported in part by Sponsors. To demonstrate the Platform’s reach and relevance, and to enable Sponsors to understand broad industry trends, Trust Agency may share Aggregated Data with Sponsors.
11.2 What we share. Aggregated Data shared with Sponsors may include overall platform usage statistics, sector-level trends, geographic distribution of interest, anonymised demographic summaries (such as professional roles and industries represented), and aggregate content engagement metrics. This data is always presented at a high level of aggregation and never identifies individual Users.
11.3 What we never share. Trust Agency will never share with Sponsors: your name, email address, organisation, Account details, individual browsing behaviour, individual content consumption patterns, or any other data that could directly or indirectly identify you as an individual.
11.4 Anonymisation safeguards. Before any data is shared with Sponsors, it is aggregated and stripped of all personal identifiers. Trust Agency applies minimum group-size thresholds to ensure that no individual can be singled out, linked, or inferred from the shared data, in accordance with the criteria established by the Article 29 Working Party Opinion 05/2014 on Anonymisation Techniques. Truly anonymised data falls outside the scope of the GDPR (Recital 26).
11.5 Transparency. A list of current Sponsor categories may be made available on the Platform upon request. Trust Agency does not sell personal data.
12.1 “As is” basis. The Platform and all Content are provided on an “as is” and “as available” basis. Trust Agency makes no representations or warranties, express or implied, regarding the Platform or Content, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, timeliness, or non-infringement.
12.2 No guarantee of accuracy. While Trust Agency uses reasonable efforts to ensure that Content is accurate and up to date, the European digital identity landscape — including ETSI standards and eIDAS regulations — evolves continuously. Trust Agency does not warrant that Content reflects the most current version of every standard, regulation, or development at all times. Users are responsible for independently verifying information before relying on it for business, compliance, or regulatory purposes.
12.3 No guarantee of availability. Trust Agency does not guarantee uninterrupted, timely, or error-free access to the Platform. The Platform may be temporarily unavailable due to scheduled maintenance, updates, technical issues, or circumstances beyond Trust Agency’s reasonable control. Trust Agency shall use reasonable commercial efforts to minimise disruptions and, where practicable, to provide advance notice of scheduled maintenance.
12.4 No professional advice. Nothing on the Platform constitutes legal, regulatory, compliance, or professional advice. Content is provided for informational and intelligence purposes only. Always consult qualified professionals before acting on information obtained through the Platform.
12.5 Third-party dependencies. The Platform is hosted by third-party infrastructure providers and relies on third-party services. Trust Agency is not responsible for outages, performance issues, or data loss attributable to third-party service providers, to the extent permitted by law.
13.1 Exclusion of indirect damages. To the maximum extent permitted by applicable law, Trust Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business opportunities, loss of data, loss of goodwill, reputational damage, or costs of procuring substitute services, arising out of or in connection with your use of or inability to use the Platform, regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if Trust Agency has been advised of the possibility of such damages.
13.2 Cap on direct damages. To the maximum extent permitted by applicable law, Trust Agency’s total aggregate liability arising out of or relating to these Terms or the use of the Platform shall not exceed the greater of: (a) the total fees actually paid by you to Trust Agency in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) one hundred euros (€100). For Users on the Free Tier who have not paid any fees, Trust Agency’s maximum aggregate liability shall not exceed one hundred euros (€100).
13.3 Basis of the bargain. The limitations and exclusions in this Section reflect a reasonable allocation of risk between the parties and form an essential basis of the agreement between you and Trust Agency. The Services would not be provided without these limitations.
13.4 Mandatory exceptions. Nothing in these Terms shall exclude or limit Trust Agency’s liability for: (a) death or personal injury caused by its negligence; (b) fraud or intentional fault (dol); (c) any liability that cannot be excluded or limited under mandatory Belgian law, including Article 5.89 of the Belgian Civil Code and the provisions of the Code of Economic Law on unfair B2B contract terms; Crowell & Moring or (d) its obligations as a data controller under the GDPR that cannot be contractually excluded vis-à-vis data subjects.
13.5 Time limitation. To the extent permitted by law, any claim arising out of or related to the use of the Platform must be brought within one (1) year from the date the cause of action arose.
14.1 You agree to indemnify, defend, and hold harmless Trust Agency, its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your violation of applicable law; (c) any User Content you submit through the Platform; (d) your infringement of any intellectual property or other right of any third party; or (e) any dispute between you and a third party arising from your use of the Platform.
15.1 Termination by you. You may terminate your Account and these Terms at any time by submitting a request through your Account settings or by contacting us at the details in Section 20. Upon termination, your access to the Platform will cease, and you must delete any downloaded Content.
15.2 Suspension by Trust Agency. Trust Agency may temporarily suspend your access to the Platform, with immediate effect and without prior notice, if Trust Agency reasonably believes that:
Trust Agency will notify you of the suspension and the reasons for it as soon as practicable.
15.3 Termination by Trust Agency. Trust Agency may terminate your Account and these Terms:
15.4 Statement of reasons. In any case of suspension or termination by Trust Agency, we will provide you with a clear statement of the reasons for our decision, unless providing such statement would compromise an ongoing investigation by a competent authority or would be prohibited by law.
15.5 Right to appeal. If you believe your Account has been suspended or terminated in error, you may submit a reasoned appeal in writing to the contact details in Section 20 within thirty (30) days of the suspension or termination. Trust Agency will review your appeal in good faith and respond within a reasonable timeframe.
15.6 Effects of termination. Upon termination of your Account for any reason:
16.1 Modifications to these Terms. Trust Agency reserves the right to modify these Terms from time to time, for objectively justified reasons, including changes in applicable law, regulatory requirements, market conditions, security considerations, or the scope of the Services.
16.2 Notification of changes. For material changes to these Terms — including changes that affect your rights, obligations, or the scope of the Services available to you — Trust Agency will notify you at least thirty (30) days before the changes take effect, via email to the address associated with your Account and/or via a prominent notice on the Platform. The notification will describe the nature of the changes and their effective date.
16.3 Acceptance of modified Terms. Your continued use of the Platform after the effective date of modified Terms constitutes your acceptance of those modifications. If you do not agree to the modified Terms, you may terminate your Account before the effective date of the changes, in which case the previous Terms will continue to govern until termination is complete.
16.4 Modifications to the Services. Trust Agency may modify, expand, or discontinue features of the Services at any time. Where a modification materially reduces functionality available to you under your current subscription tier, the notice provisions of Section 5.3 apply.
16.5 Version history. Trust Agency will maintain an archive of previous versions of these Terms, accessible upon request.
17.1 Trust Agency shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters, pandemics, epidemics, war, terrorism, civil unrest, government actions or sanctions, cyberattacks, power outages, internet disruptions, failures of third-party hosting or infrastructure providers, or changes in applicable law or regulation.
17.2 If a force majeure event continues for more than ninety (90) consecutive days, either party may terminate these Terms by written notice to the other.
18.1 Governing law. These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict-of-law provisions.
18.2 Jurisdiction. Any disputes arising out of or in connection with these Terms, including disputes relating to their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the Enterprise Court of Leuven (Ondernemingsrechtbank Leuven), Belgium.
18.3 Amicable resolution. Before initiating formal proceedings, the parties shall endeavour in good faith to resolve any dispute amicably through direct negotiation for a period of at least thirty (30) days following written notice of the dispute.
18.4 Mandatory local laws. These Terms are intended to apply globally. To the extent that mandatory provisions of the law of the jurisdiction in which you are established require the application of different rules, such mandatory provisions shall apply to the minimum extent required by law, and all other provisions of these Terms shall remain in full force and effect.
18.5 Severability of jurisdiction clause. If the jurisdiction clause in Section 18.2 is found to be unenforceable in a particular jurisdiction, the parties agree to submit to the jurisdiction of the competent courts of Leuven, Belgium, as a non-exclusive forum, without prejudice to Trust Agency’s right to bring proceedings in any other court of competent jurisdiction.
19.1 Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Trust Agency with respect to the subject matter hereof and supersede all prior or contemporaneous communications, whether written or oral.
19.2 Severability. If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect.
19.3 No waiver. No failure or delay by Trust Agency in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. A single or partial exercise of any right, power, or remedy does not preclude any other or further exercise of that right or any other right.
19.4 Assignment. Trust Agency may assign or transfer its rights and obligations under these Terms to any affiliate or successor entity, or in connection with a merger, acquisition, or sale of all or substantially all of its assets, without your prior consent but with notice to you. You may not assign or transfer your rights or obligations under these Terms without Trust Agency’s prior written consent.
19.5 Notices. Notices from Trust Agency to you will be sent to the email address associated with your Account and are deemed received upon sending. Notices from you to Trust Agency must be sent to the contact details in Section 20 and are deemed received upon actual receipt.
19.6 No third-party beneficiaries. These Terms do not create any rights for any third party, except as expressly provided herein.
19.7 Relationship of the parties. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Trust Agency.
19.8 Language. These Terms are drafted in English. If these Terms are translated into any other language, the English version shall prevail in the event of any conflict or inconsistency.
19.9 Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
